General Event Terms and Conditions

§1 General

1.1 These are the general event conditions for all events under the “IT Futures” brand, valid from October 23, 2023 until the publication of a modified version of these event conditions.

1.2 The organizer is 72net.io e.U., Hafenstraße 47-51, 4020 Linz, email: hello@72net.io

1.3 The organizer uses the event space based on a rental agreement with the owner of the event space.

1.4 Every registration for and participation in this event is subject to the general event conditions of 72net.io e.U. as well as the conditions and house rules of the respective event room landlord. The latter are available from the organizer upon request.

§2 Conclusion of Contract with Exhibitors/Sponsors

2.1 Contracts are concluded through the order confirmation or in the form of a commercial confirmation letter from 72net.io.

2.2 The exhibitor’s general terms and conditions only apply to the extent that they correspond to the organizer’s general terms and conditions. If the exhibitor’s general terms and conditions conflict, general law applies.

§3 Exhibitor Spaces/Allocation

3.1 Booth location requests and their assurances require the prior approval of 72net.io e.U., in writing and are only possible in exceptional cases.

3.2 72net.io e.U. does not provide any protection from competition.

3.3 72net.io e.U. decides alone about the stand allocation to the best of its knowledge and belief. The exhibitor has no influence on this. Special requests regarding the allocation of places must be made in writing as set out in §3.1. Claims for compensation are excluded on both sides.

3.4 The exhibitor is prohibited from accommodating co-exhibitors at his trade fair stand without the prior written consent of 72net.io.

3.5 If an exhibition space is used together, both exhibitors are jointly and severally liable.

3.6 The main exhibitor is responsible for passing on safety instructions and information regarding the trade fair appearance and the underlying contracts and regulations.

3.7 If you register after the deadline for creating various printed materials has expired, some of the services included in the exhibitor package may no longer be able to be provided to the exhibitor. You can find out more about the services at 72net.io. In this case, there is no entitlement to a reduction in the agreed fee.

§4 Registration for Participants

4.1 DRegistration takes place exclusively online via the event website www.it-futures.com

4.2 By submitting the online booking on the event website, each participant accepts the general event conditions as binding. He guarantees that any people he may send as replacements, as well as any people he might employ at the event, receive the entire contract and are bound by it.

4.3 Exclusion of competition is not permitted.

§5 Cancellation, non-participation Exhibitors/Sponsors

5.1 Orders canceled by May 31st, 2024 will be charged 25% of the invoice amount.

5.2 Orders canceled by July 31st, 2024 will be charged 50% of the invoice amount.

5.3 Orders canceled after this and up to the start of the trade fair must be paid in full.

§6 Termination of the Contract by the Organizer:

6.1 72net.io e.U. is entitled to terminate the contract if full payment of the amounts due is not received by the date specified in the invoice at the latest. In this case, the organizer can also assert claims for compensation. §5.1 applies accordingly in this case.

6.2 The organizer is entitled to terminate the contract up to 30 days before the start of the event if the event has to be canceled due to a foreseeable lack of participation from visitors and/or exhibitors. At this point, payments already made to the organizer by exhibitors, sponsors or participants will be refunded by the organizer. Further claims against the organizer are excluded.

6.3 The organizer can prohibit individual participants or exhibitors from taking part in the event at any time and cancel the bookings of individual participants, partners, sponsors or exhibitors without requiring any special justification. The canceled participant, partner, sponsor or exhibitor will receive a full refund of the amounts already paid from the organizer. Furthermore, further claims against the organizer are excluded.

§7 Payment Terms

7.1 Unless otherwise stated, all prices are exclusive of statutory sales or value-added tax.

7.2 The amounts invoiced before the event are payable immediately upon receipt of the invoice, in any case (even in the case of short-term registration) no later than 5 days before the start of the event without deduction.

7.3 In the event of late payment, default interest of 7% above EURIBOR will be due.

§8 Liability

8.1 The organizer is liable – regardless of the legal basis – only in the event of intent or gross negligence or if a written guarantee is given or if an essential contractual obligation is breached. However, in the event of a breach of an essential contractual obligation and in the event of the assumption of a written guarantee, the claim for damages is limited to such foreseeable damage, the occurrence of which should have been prevented by the essential contractual obligation or the guarantee assumed. In any case, liability – to the extent permitted by law – is limited to a total amount of EUR 5,000.

8.2 The event premises are controlled and monitored by the organizer’s employees to the extent usual for such events. The participant or exhibitor must keep valuable and easily removed items under supervision or locked away at all times. It is recommended for exhibitors to take out exhibitor insurance. The organizer assumes no liability for loss or damage.

§9 Setting up and dismantling the Exhibitor Stands

9.1 The general terms and conditions of the venue also apply to exhibition operations.

9.2 The design and construction of the individual exhibition stands must be carried out in such a way that no neighboring exhibitors are hindered or obscured by exhibits, advertising spaces or display objects.

9.3 The specified stand dimensions must not be exceeded. Exceeding the prescribed dimensions is only permitted with the express consent of the organizer.

9.4 Before planning the construction of his stand, the exhibitor is obliged to inform himself in good time about the structural conditions of his booked stand area (pillars, fire protection devices, etc.) from the organizer or the landlord of the event space.

9.5 All materials used in construction must be flame-retardant and comply with the legal requirements of the fire protection regulations and building regulations.

9.6 In the event of violations of the design regulations mentioned, the organizer can demand the necessary changes and, if necessary, the removal of the stand. If the organizer’s request is not followed, the organizer can arrange for the stand to be changed or removed at the exhibitor’s expense. In the event of the stand being closed, the exhibitor must bear the full rent and the costs incurred by the organizer.

9.7 Set-up must take place by 8:00 p.m. the evening before or within the time window specified on the day of the event, and dismantling must take place on the same day of the last day of the trade fair. Deviations must be in writing.

9.8 The exhibitor must adhere to the set-up and dismantling times. Any additional costs that the organizer incurs due to the exhibitor not adhering to the times must be borne by the exhibitor. Unless the organizer has informed the exhibitor otherwise in writing, the stand construction must be completely completed by 8 a.m. on the first day of the event so that proper technical acceptance and cleaning can be carried out before the opening.

9.9 Exhibition space that is not occupied on the day of construction will be allocated elsewhere with consideration to the overall picture, with the organizer either moving another exhibitor to the unoccupied stand or filling or decorating the stand in another way. In this case, the exhibitor must bear any additional costs that may arise. Claims for damages by the exhibitor are excluded.

9.10 Dismantling will take place on the last day of the trade fair from 5:30 p.m. and must be completed by 9:00 p.m. on the same day.

9.11No stand may be vacated in whole or in part before the end of the conference. Since this affects the overall picture and the course of the conference and leaves a negative impression on the participants, a flat-rate payment by the exhibitor of 10% of the invoiced services will be agreed in this case.

9.12 The exhibition space must be returned in its original condition. Applied material, carpet tape and adhesive residue must be removed without any damage to the surface. Otherwise, the organizer is entitled to have this work carried out at the exhibitor’s expense. The exhibitor is also liable for damage to the floors, walls and the material provided for rent or loan. The organizer reserves the right to further claims for damages.

§10 Further Regulations for Exhibitors and Sponsors

10.1 Exhibitors must generally obtain official approvals. He is responsible for ensuring that commercial, police, health and other legal regulations are adhered to. He must also observe the “Technical Guidelines” of the event location and, in particular, any safety regulations of the landlord of the event space.

10.2 The supply of electricity and other services in the exhibition area is provided exclusively by the companies approved by the organizer.

10.3 Cleaning: The organizer ensures the general cleaning of the area and the hall aisles. The exhibitor is responsible for cleaning the stand. The exhibitor or the stand builder he commissions is responsible for the disposal of the waste he creates.

10.4 Unless otherwise agreed with the organizer, advertising of any kind is only permitted within the stand rented by the exhibitor for its own company and only for the goods or services it produces or sells. Loudspeaker advertising, film screenings and shows require a written agreement with the organizer. The same applies to the use of other devices and facilities that are intended to achieve an increased advertising effect in a visual and acoustic manner. Political advertising or advertising that offends morals is generally not permitted.

10.5 Documents and stand equipment must be sent to the event location in advance in compliance with the procedure and deadlines announced by the organizer. In any case, all packages to the event location must be clearly labeled with the following features: name of the sender company, contact person & Telephone number as well as “IT Futures” and the respective date of the trade fair. Additional costs incurred by the organizer due to non-compliance with this procedure will be passed on to the exhibitor and must be paid by the exhibitor.

§11 Other General Regulations

11.1 The tickets for the event are personal and NOT transferable.

11.2 As part of the entire event, it is generally not permitted to advertise or display advertising material outside of the exhibition stands, unless this has been booked separately or agreed otherwise in writing with the organizer.

11.3 The organizer is entitled to take or have made photographs, drawings as well as film and video recordings of the exhibition events, of the people at the event, of the exhibition buildings and stands as well as the exhibition objects and to use them for advertising, publication on the website or press releases. This also applies to recordings made by the press or television with the consent of the organizer.

11.4 As a participant in this event, you agree that your registration data (name, job title, email) may be used to send you material for the purpose of promoting the event and the organizer. By registering, participants in the trade fair agree that their registration data (name, job title, email) may also be passed on to the event’s sponsors and partners. In addition, the organizer will not pass on the data to third parties.

§12 Final Determinations

12.1 The parties mutually agree not to contest this Agreement for any reason whatsoever.

12.2 Subsidiary agreements are not valid. Changes to the contract must be made in writing. The waiver of this formal requirement can also only be declared in writing.

12.3 The contracting parties also expressly agree that any legal successors will be bound by the rights and obligations arising from this contract.

12.4 Statute of limitations: Claims by the exhibitor or participant against the organizer expire within 12 months after the end of the event, unless mandatory legal regulations conflict with this.

12.5 If individual provisions of this contract are invalid, the rest of this contract remains valid. In such a case, the invalid provision of the contract must be replaced by a meaningful, effective provision that most closely achieves the intended economic purpose of the invalid provision.

12.6 If gaps that need to be filled arise during the implementation of this contract, the contracting parties undertake to fill them in such a way that the intended economic purpose is achieved.

12.7 Behavior that deviates from the contract does not change or cancel agreed rights and obligations, nor does it create new rights and obligations.

12.8 The competent court in Linz/Austria is agreed as the place of jurisdiction for all disputes in the fulfillment of this contract and from this contract.

12.9 The contracting parties agree exclusively to the application of Austrian law.
